1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of PlayKorte's website, applications, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Platform.
2. About PlayKorte
PlayKorte is an online court booking and payments platform for sports facilities in the Philippines.
Through the Platform:
- Players can search for facilities, view availability, and book court time.
- Facilities can publish their courts, pricing, and availability, and receive booking payments.
PlayKorte is a technology and payments facilitation service. PlayKorte does not own, operate, manage, or control any facilities, and is not responsible for the condition, safety, or operation of any court or venue.
3. Roles and Relationships
3.1 Players
"Players" are individual users who use the Platform to:
- Search for sports facilities and available court times.
- Make bookings and payments through the Platform.
- Comply with facility rules and house policies.
Players are responsible for:
- Providing accurate contact details and payment information.
- Honoring their bookings or cancelling according to the applicable policy.
- Their own conduct and safety at the facility.
3.2 Facilities
"Facilities" are operators of sports courts and venues who use the Platform to:
- List courts, schedules, and pricing.
- Accept bookings from Players.
- Receive booking proceeds through their PayMongo child merchant setup on PlayKorte.
Facilities are solely responsible for:
- The accuracy of their listings, prices, rules, and availability.
- The quality, safety, and legality of their courts and venues.
- On-site customer service, staff conduct, and compliance with local laws.
Facilities are subject to additional terms under the Facility Terms of Service.
3.3 PlayKorte
PlayKorte:
- Provides the Platform that connects Players and Facilities.
- Facilitates payments through third-party payment processors such as PayMongo.
- Acts as a collection and payment agent on behalf of Facilities for bookings made through the Platform.
PlayKorte is not:
- A party to the agreement between Players and Facilities for the use of a court.
- A bank, money remittance business, or licensed escrow agent.
- Responsible for the condition of facilities, equipment, or on-site incidents.
4. Account Registration and Use
- You must be at least 18 years old and legally capable of entering into contracts under Philippine law to use the Platform. If PlayKorte determines that a user is under 18, the account may be immediately suspended or terminated.
- You agree to provide accurate, current, and complete information during registration and to keep your information up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- PlayKorte may suspend or terminate accounts that violate these Terms or applicable laws.
If your account is suspended or terminated for cause:
- Pending bookings may be cancelled at PlayKorte's discretion.
- You are not entitled to a refund of any fees already paid.
- PlayKorte may permanently bar you from re-registering.
- PlayKorte reserves the right to pursue any available legal remedies.
5. Payments, Fees, and Escrow Limits
5.1 Payment Processing
When a Player confirms a booking on the Platform, the total amount due (court fee plus any applicable PlayKorte fees) is charged immediately to the selected payment method.
Payments are processed by PayMongo. Where PlayKorte has activated split payments for a Facility, the Facility's court-fee share is allocated to that Facility's PayMongo child merchant account and PlayKorte's booking-fee share is allocated to PlayKorte. By using the Platform, you also agree to be bound by the terms and policies of these providers.
5.2 Holding of Funds and Escrow Limit
PayMongo controls merchant payout timing, payout destination, and related settlement behavior based on merchant onboarding status, payout settings, and PayMongo's policies.
PlayKorte acts as a collection and payment agent for Facilities but is not a licensed escrow agent, custodian, or bank, and does not maintain segregated client trust accounts.
Any references to "holding" or "reserving" funds on the Platform relate to booking state, payment authorization, refund processing, or provider-controlled payout timing. They do not create a regulated escrow arrangement.
5.3 Fees
- Facilities may pay subscription fees or other service fees to use the Platform (as described on the Pricing page).
- Players pay a booking fee on each online reservation made through the Platform. The current booking fee rate and cap are shown on the Pricing page and at checkout.
- PayMongo payment-method fees, disbursement fees, and other processor charges are allocated as shown on the Pricing page.
- Fee rates, caps, fee-allocation rules, and supported payment rails may change at any time upon posting on the Platform, without prior notice.
- All prices and fees are shown and charged in Philippine Pesos (PHP), unless stated otherwise.
5.4 Payouts to Facilities
Payouts to Facilities are handled within PayMongo's merchant and payout system for each activated Facility Sub-Merchant Account.
PlayKorte may pause online payment features, facility approval, or operational access while refunds, chargebacks, fraud reviews, or compliance issues are investigated.
Where PayMongo or applicable law does not automatically net amounts owed by a Facility, PlayKorte may recover those amounts by invoice or any other lawful method described in the Facility Terms.
6. Cancellations, No-Shows, and Refunds
This section is high-level. The detailed rules appear on our separate Refund Policy, which is incorporated by reference into these Terms.
6.1 Player Cancellations
Each booking is subject to the platform-wide cancellation policy:
- Cancellations made at least twenty-four (24) hours before the scheduled start time: Eligible for a refund of the court fee only.
- Cancellations made within twenty-four (24) hours of the scheduled start time: Non-refundable.
- Booking fee is non-refundable for Player-initiated cancellations.
- No cancellation or refunds after start: Once the booking or session start time has passed, PlayKorte cancellation and refund options are not available.
- No partial-time refunds in this release: Partial refunds for unused remaining time after start are not currently supported.
PayMongo processing fees are non-refundable by PayMongo. For Player cancellations within policy (24+ hours), the Player bears the processing fee loss.
6.2 No-Shows
If a Player does not attend the booking and does not cancel in accordance with the policy, the booking will be treated as a no-show.
No-shows are non-refundable.
6.3 Facility Cancellations
If a Facility cancels a confirmed paid booking before the booking/session start time (for example, due to weather, maintenance, or other valid reasons), the Player will be entitled to a full refund of the court fee and booking fee.
In cases of Facility cancellation, the booking fee amount refunded to the Player may be charged back to the Facility account or deducted from Facility payouts.
If the booking/session has already started, Facility-initiated cancellation and refund through PlayKorte are not available.
6.4 How Refunds Are Processed
- Approved refunds are usually processed back to the original payment method, where technically possible, subject to PayMongo and bank or e-wallet rules.
- Automated refunds can fail if the responsible merchant account does not have enough refundable balance or if the payment rail does not support the refund flow. In those cases, manual support handling may be required.
- QRPh payments do not currently support automated refunds and may require manual support handling.
- Refund processing times vary depending on the payment method and intermediaries and are outside of PlayKorte's direct control.
7. Chargebacks and Disputes
If a Player disputes a card or e-wallet charge and initiates a chargeback, PlayKorte will provide available booking records to PayMongo and the issuing bank.
If a chargeback or dispute is resolved in favor of the Player, PlayKorte may:
- Deduct the disputed amount and any associated fees from current or future payouts to the Facility; or
- Invoice the Facility or Player (as applicable) for the amount owed, payable on demand.
Facilities and Players agree that PlayKorte's system records (including timestamps, check-in records, and communication logs) are primary evidence of the transactions that occurred via the Platform.

8. User Conduct and Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose.
- Attempt to interfere with or compromise the Platform's security or operation.
- Misrepresent your identity or affiliation.
- Circumvent or manipulate fees, payments, or booking rules.
- Use stolen, unauthorized, or fraudulent payment methods.
- File false or abusive chargebacks.
- Create multiple accounts to circumvent restrictions or bans.
- Engage in any form of fraud or deception on the Platform.
PlayKorte may suspend or terminate accounts, cancel bookings, forfeit payments, and pursue legal remedies for conduct that violates these Terms or harms other users.
8.1 Abuse Patterns
PlayKorte may restrict, suspend, or terminate accounts that show a pattern of abuse, including:
- Repeated no-shows without cancellation.
- Excessive last-minute cancellations.
- Chargeback abuse or repeated payment disputes.
PlayKorte is not obligated to refund any fees in connection with accounts restricted or terminated for abuse.
9. Intellectual Property
The Platform and all associated content, trademarks, and materials are owned by or licensed to PlayKorte and are protected by intellectual property laws.
You may not copy, modify, distribute, or create derivative works based on the Platform except as expressly permitted by PlayKorte in writing.
10. Limitation of Liability
10.1 Assumption of Risk
Sports and physical activities involve inherent risks, including the risk of physical injury. By booking or participating in any activity through the Platform, you acknowledge these risks and voluntarily assume them. PlayKorte is not liable for any injury, illness, or harm arising from your participation in sports or recreational activities booked through the Platform.
10.2 Limitation
To the maximum extent permitted by law:
- PlayKorte is not liable for any injury, accident, loss, or damage that occurs at or around any Facility, or that results from the actions or omissions of any Facility or Player.
- PlayKorte is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, even if advised of the possibility of such damages.
- PlayKorte's total aggregate liability to any user for any claim arising out of or relating to the Platform will not exceed the greater of: (a) the total fees that user has paid to PlayKorte through the Platform in the twelve (12) months preceding the event giving rise to the claim, or (b) ten thousand Philippine pesos (₱10,000).
Nothing in these Terms excludes liability where such exclusion is not allowed under applicable law.
11. Indemnification
You agree to indemnify and hold harmless PlayKorte, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:
- Your use of the Platform;
- Your breach of these Terms; or
- Your violation of any law or third-party right.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines.
Any dispute arising out of or in connection with these Terms or the Platform shall first be resolved through good faith negotiation between the parties for a period of thirty (30) days from written notice of the dispute. If the dispute remains unresolved, the parties shall attempt mediation before a mutually agreed mediator. If mediation fails or is not initiated within sixty (60) days of the original written notice, either party may submit the dispute to the exclusive jurisdiction of the courts of Dumaguete City, Philippines.
13. Changes to the Terms
PlayKorte may update these Terms from time to time. When changes are made, the "Last updated" date at the top of this page will be revised, and the updated Terms will be posted on the Platform.
For fee-related items (including fee rates, caps, fee-allocation rules, and supported rails), updates may take effect immediately once posted on the Platform.
Your continued use of the Platform after the updated Terms are posted constitutes your acceptance of the changes.
14. Force Majeure
PlayKorte is not liable for any delay or failure to perform its obligations under these Terms caused by events beyond its reasonable control, including but not limited to:
- Natural disasters, typhoons, earthquakes, volcanic activity, or flooding.
- Internet, telecommunications, or power outages.
- Pandemics, epidemics, or public health emergencies.
- Government orders, regulations, or restrictions.
- War, civil unrest, or acts of terrorism.
PlayKorte's obligations are suspended for the duration of such events.
15. General Provisions
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
- Entire Agreement. These Terms, together with the Facility Terms of Service, Privacy Policy, and Refund Policy, constitute the entire agreement between you and PlayKorte regarding the Platform.
- Assignment. PlayKorte may assign its rights and obligations under these Terms without your consent (for example, in connection with a merger or acquisition). You may not transfer or assign your account or any rights under these Terms.
- Waiver. PlayKorte's failure to enforce any provision of these Terms is not a waiver of its right to enforce that provision in the future.
- Electronic Communications. You agree that communications from PlayKorte via the Platform, email, SMS, or push notifications constitute valid notice under these Terms.
