1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of PlayKorte's website, applications, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Platform.

2. About PlayKorte

PlayKorte is an online court booking and payments platform for sports facilities in the Philippines.

Through the Platform:

PlayKorte is a technology and payments facilitation service. PlayKorte does not own, operate, manage, or control any facilities, and is not responsible for the condition, safety, or operation of any court or venue.

3. Roles and Relationships

3.1 Players

"Players" are individual users who use the Platform to:

  • Search for sports facilities and available court times.
  • Make bookings and payments through the Platform.
  • Comply with facility rules and house policies.

Players are responsible for:

  • Providing accurate contact details and payment information.
  • Honoring their bookings or cancelling according to the applicable policy.
  • Their own conduct and safety at the facility.

3.2 Facilities

"Facilities" are operators of sports courts and venues who use the Platform to:

  • List courts, schedules, and pricing.
  • Accept bookings from Players.
  • Receive payouts from PlayKorte for completed bookings.

Facilities are solely responsible for:

  • The accuracy of their listings, prices, rules, and availability.
  • The quality, safety, and legality of their courts and venues.
  • On-site customer service, staff conduct, and compliance with local laws.

3.3 PlayKorte

PlayKorte:

  • Provides the Platform that connects Players and Facilities.
  • Facilitates payments through third-party payment processors such as PayMongo.
  • Acts as a collection and payment agent on behalf of Facilities for bookings made through the Platform.

PlayKorte is not:

  • A party to the agreement between Players and Facilities for the use of a court.
  • A bank, money remittance business, or licensed escrow agent.
  • Responsible for the condition of facilities, equipment, or on-site incidents.

4. Account Registration and Use

PlayKorte may suspend or terminate accounts that violate these Terms or applicable laws.

5. Payments, Fees, and Escrow Limits

5.1 Payment Processing

  • When a Player confirms a booking on the Platform, the total amount due (court fee plus any applicable PlayKorte fees) is charged immediately to the selected payment method.
  • Payments are processed by third-party payment providers such as PayMongo. By using the Platform, you also agree to be bound by the terms and policies of these providers.

5.2 Holding of Funds and Escrow Limit

  • PayMongo's current capacity is to hold payments for up to seven (7) days before releasing them to PlayKorte or directly to the Facility.
  • After funds are released by PayMongo, they are no longer held in escrow by the payment provider. At that point, they are subject to PlayKorte's payout schedule and risk policies.
  • PlayKorte acts as a collection and payment agent for Facilities but is not a licensed escrow agent, custodian, or bank, and does not maintain segregated client trust accounts.

Any references to "holding" or "reserving" funds on the Platform relate to this limited holding period and PlayKorte's internal payout rules, not to a regulated escrow arrangement.

5.3 Fees

  • Facilities may pay subscription fees or other service fees to use the Platform (as described on the Pricing page).
  • Players may pay a booking fee on each reservation made through the Platform. As of the effective date of these Terms, Players pay a booking fee of five percent (5%) of the booking value, capped at one hundred Philippine pesos (₱100) per booking. This may be updated from time to time as shown on the Platform.
  • All prices and fees are shown and charged in Philippine Pesos (PHP), unless stated otherwise.

5.4 Payouts to Facilities

  • PlayKorte aggregates completed bookings and pays out to Facilities on a scheduled basis (for example, weekly), less applicable fees, adjustments, and reserves.
  • PlayKorte may maintain a rolling reserve of up to seven (7) days of bookings and may delay payouts to cover potential refunds, chargebacks, fraud, or other risk-related events.
  • PlayKorte may offset any amounts owed by a Facility (including refunds, chargebacks, penalties, or unpaid fees) against current or future payouts.

6. Cancellations, No-Shows, and Refunds

This section is high-level. The detailed rules may also appear on a separate "Refunds & Cancellations" page, which is incorporated by reference into these Terms.

6.1 Player Cancellations

  • Each booking is subject to the cancellation policy indicated at the time of booking or on the Platform.
  • As a default policy, cancellations made at least twenty-four (24) hours before the scheduled start time may be eligible for a refund of the court fee, subject to the rules of the Facility and PlayKorte's refund procedures.
  • Cancellations made within twenty-four (24) hours of the scheduled start time may be non-refundable or partially refundable, depending on the policy in force.

6.2 No-Shows

  • If a Player does not attend the booking and does not cancel in accordance with the policy, the booking will be treated as a no-show.
  • No-shows are generally non-refundable.

6.3 Facility Cancellations

  • If a Facility cancels a confirmed booking (for example, due to weather, maintenance, or other valid reasons), the Player will normally be entitled to a full refund of the court fee or an alternative arrangement such as a rescheduled booking, as described on the Platform.

6.4 How Refunds Are Processed

  • Approved refunds are usually processed back to the original payment method, where technically possible, subject to PayMongo and bank or e-wallet rules.
  • In some cases, PlayKorte may process refunds as wallet credits or alternative payout methods.
  • Refund processing times vary depending on the payment method and intermediaries and are outside of PlayKorte's direct control.

The eligibility for a refund is not dependent on whether PayMongo is still holding the funds. Where necessary, PlayKorte may refund a Player and later recover the corresponding amount from future payouts to the Facility.

7. Chargebacks and Disputes

Facilities and Players agree that PlayKorte's system records (including timestamps, check-in records, and communication logs) are primary evidence of the transactions that occurred via the Platform.

8. User Conduct and Acceptable Use

You agree not to:

Nothing in these Terms excludes liability where such exclusion is not allowed under applicable law.

You agree to indemnify and hold harmless PlayKorte, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines.

Any dispute arising out of or in connection with these Terms or the Platform shall be submitted to the exclusive jurisdiction of the courts of Dumaguete City, Philippines.

13. Changes to the Terms

PlayKorte may update these Terms from time to time. When changes are made, the "Last updated" date at the top of this page will be revised, and the updated Terms will be posted on the Platform.

Your continued use of the Platform after the updated Terms are posted constitutes your acceptance of the changes.
